Probably the most common types of easements on a property are:

  • the right of way
  • the right to light
  • the right to bring underground services (water, gas, electricity, drainage, telephone and other cables)
  • the right to hang a sign

How an easement on property / land can be created...

The following are different ways in which an easement on property can be created:

  • By express grant where the terms of the easement are contained within the property deeds
  • Of necessity: for example over a road, track or path where it is the only route between the land and public highway
  • By prescription: when an act is carried out repeatedly without the landowner's permission for 20 years (this period is increased to 60-years where the property is owned by the Crown or Church).

So details of property easements are usually contained within the title deeds to the property. An easement on property cannot be sold separately, but will pass on with the land whenever ownership is transferred. Once in place, property easements should be considered as being permanent.

If I own the property, surely I can do what I want with it?

Unfortunately, you cannot.

As mentioned above, property easements are a right, and as an owner of land, you must respect the rights of others over your property. Your solicitor will point out any rights of way over the property you are going to buy at the time of purchase.
