Mortgages and Solicitors: The role of the Solicitor within the Mortgage and home-buying process explained, plus our available help!

'Why do I need a Solicitor to act for me when I'm buying a house?' you may well be asking. Well, Solicitors play a vital role in protecting your interests during the course of the home buying process. What is certain is that you won't get a mortgage without appointing a Solicitor, (or licensed conveyancer if acceptable to the lender).

Here we take a more detailed look at the role of Mortgage Solicitors within the mortgage process and detail how we can help arrange both your mortgage AND your solicitor!

Which Solicitor and which type of Solicitor should I choose when it comes to my mortgage?

There are many types of Solicitor's practice, and although most offer a conveyancing service, it is the specialist conveyancer that will often provide an efficient and quicker service by the application of sophisticated technology and good case management.

Many traditional family solicitor firms deal in a wide variety of services, and often don't have the skills and resources that special conveyancing solicitors can provide. Conveyancing is advancing at a rapid pace, and government targets will require all conveyancing to be undertaken electronically by 2010, and this will mean a huge hi-tech investment by solicitors firms.

However, this new technological approach must be blended with good personal relationships with the conveyancing staff. Here at Shire Direct, we have arrangements with panel solicitors who properly satisfy the service demands of our customers.

So our objective is to be able to recommend a solicitor's practice who are able to provide excellent technological skills, robust relationship dealings, and a high level of trust together with a track record that can demonstrate a slick, efficient and fast conveyancing service, with as few complications as possible.

Our professional partnership dealings with our panel solicitors have enabled us to negotiate special fixed-fee terms for our customers, and we will of course be happy to provide details of these packages to you.

The Solicitors role in the Mortgage process explained

Basically, the solicitor's role in the house buying process will include the following steps:

  • Request property documents from the vendor's solicitor
  • Conducting Property Searches
  • To prepare contracts for both parties signatures, once the contract terms have been agreed, Searches have been returned and dealt with, enquiries have been answered, and your Mortgage Offer is sufficient.
  • To exchange contracts with the vendor's solicitor. This makes the agreement binding.
  • To prepare transfer documents to transfer the property into your name.
  • To complete the purchase on the agreed date.

    Mortgage Completion involves:

    • sending your payment to the vendor's solicitor
    • receiving your Mortgage Deeds from the vendor's solicitor
    • transferring ownership from the vendor to you
    • activating the mortgage
    • registering your ownership at the Land Registry
    • forwarding the Deeds to your lender
