Disbursements explained and available mortgage help!

Disbursements is the name given to an expense your solicitor will pay out on your behalf during his involvement in the mortgage process.

Here we explain Disbursements and the services they are likely to cover for both mortgage, and remortgage transactions. We also provide details of our solicitor arrangements for the mortgage and remortgage services we offer, and information as to how we can assist you.

What are disbursements? The definition of disbursements...

So, as we touched upon during the introductory paragraphs, disbursements is the name given to a cost your Solicitor will pay out on your behalf during their involvement within the mortgage process.

Disbursements will vary on the type of transaction the Solicitor is acting upon, i.e. sale, purchase or remortgage, as each one has different aspects and services involved. The costs will also vary from property to property.

A breakdown of possible Mortgage Disbursements

So, for a mortgage, disbursements may include many different types of property searches, and could include some or all of the following types of expenditure. We can split the likely disbursements to the three stages involved in the transaction.

  • Pre-Exchange Searches
    • Local Authority Search:
This will obtain information from the local council regarding the property
    • Water Search:
This will provide details about the water supply and sewerage disposal
    • Coal Mining Search:
Only undertaken in coal-mining areas, this search reveals details if the property is affected by mining subsidence etc.
    • Environmental Search:
This may be required, particularly on newer homes.

  • Pre-Completion
    • Bankruptcy Search:
This search is required by lenders to confirm you are not bankrupt
    • Land Registry Search:
This search confirms any mortgage that must be settled by the vendor (seller)
    • Bank Charges:
These will be the lender's charge to provide immediately cleared funds by Telegraphic Transfer, or the costs of special cheque clearance.

  • After Completion Payments
    • Stamp Duty Land Tax:
Stamp Duty is payable on the transfer document, and is levied on all purchases from £125,001 or more as follows:
      • 0% if the purchase price is £125,000 or less
      • 1% on the purchase price is £125,001 - £250,000
      • 3% on the purchase price is £250,001 - £500,000
      • 4% on purchase prices in excess of £500,001
    • Land Registry Fees:
This fee is payable to HM Land Registry for issuing a charge certificate.

Disbursements on Remortgage

The disbursements on remortgaging are not as voluminous or expensive! The Solicitor's disbursements here will include some or all of the following:

  • Office Copy Entry Fees
  • Official Search Fee
  • Bankruptcy Search Fee
  • Insurances
  • Land Registry Fees
  • Telegraphic Transfer Fees

Other possible Solicitor costs

In addition to the solicitor's disbursements, i.e. the costs the solicitor incurs on your behalf, there will also be other costs and expenses. Usually these are charged as an all-encompassing fee for the solicitors legal work and will generally include an amount for issuing correspondence, postage, telephone calls and fax transmissions.

However, any special additional work that may be carried out by the Solicitor is likely to be invoiced separately.

Additional work may include "transfers of equity", e.g. removing a former partner's name from the ownership, or adding a new partner into ownership.

THINK CAREFULLY BEFORE
SECURING OTHER DEBTS AGAINST YOUR HOME.
YOUR HOME MAY BE REPOSSESSED
IF YOU DO NOT KEEP UP REPAYMENTS ON A MORTGAGE OR ANY OTHER DEBT SECURED ON IT.

Adding existing debt to your mortgage will increase the repayment term and overall cost.
