County Court Judgements explained plus available help and mortgage solutions!
County Court Judgements (or CCJs for short) are the result of civil action for the recovery of debt by a creditor in the county courts. County Court Judgements can make life difficult when it comes to getting a mortgage or remortgage.
Here we explain more about County Court Judgements and how the process works, how it might affect you when it comes to getting a mortgage or remortgage, along with information as to how we can assist you.
What is a County Court Judgement?
So, as we briefly mentioned earlier, a County Court Judgement (commonly abbreviated to CCJ), is the result of civil action for the recovery of debt by a creditor in the county courts. Once registered, a County Court Judgement can have a serious impact on obtaining a mortgage and credit facilities for years ahead!
How does the County Court Judgement process work?
It may be worth just checking how the CCJ process works:
- If you have failed to pay one of your creditors the amount they claim you owe, they will usually put into action a series of measures to attempt to recover the debt.
- This process will generally involve issuing a series of letters to remind you of your obligations, if these do not produce payment of the account, then the next step will involve passing your file to a firm of debt collectors.
- The debt collection agency will issue a stern warning that if you have not settled your indebtedness within ten days or so, then your account will be referred to county court for recovery and costs.
- If the debt remains unpaid a county court summons will be issued to you, and you have the opportunity to defend the action, either in writing, or by personal attendance at the hearing.
- If there is no dispute, then the court will award judgement against you.
- A debtor will usually have 28 days in which to settle the amount, before the action is recorded on the Register as a County Court Judgement.
- The County Court Judgement will remain on your credit file for 6 years.
- If you settle the debt before the end of the 6 year term registration period, the entry will still remain on the Register, however, it is possible to have the County Court Judgement noted as being "Satisfied", by providing a CCJ Certificate of Satisfaction from the court for a fee.
How can a County Court Judgement affect me getting a mortgage?
If you do have a County Court Judgement registered against you, it's likely that you will have already experienced difficulties in obtaining facilities such as credit or store cards, HP or bank loans. As part of their credit checks, mortgage lenders will also be interested in any adverse credit you may have registered against you, and so you may require specialist help.
Generally, traditional high street lenders have tended to decline applications for funding where a borrower may have a County Court Judgement registered against them. Here at Shire Direct, we realise that in reality however, many of us will encounter some form of financial difficulty, and quite often through no fault of our own. Illness, redundancy, partnership breakdowns, and family bereavement can all have a devastating effect on our personal lives and our finances.
That's why we have incorporated a range of specialist lenders within our portfolio of lenders who will look to your ability to pay based on your current and future strengths, rather than your past difficulties. That's why if you need mortgage facilities and have a county court judgement registered against you, whether it is satisfied or not, it really is important to seek the advice of a specialist professional mortgage broker like Shire Direct.
